Conditions of Use
The POOL/PACT website is a free service of POOL/PACT. Anyone can visit it, but certain content is restricted to our members and brokers servicing our members. Qualified member institutions must currently be a contributing member of either POOL or PACT.
The material is presented for informational purposes only and should not be considered legal advice or used as such. POOL/PACT members should consult their own counsel for legal advice. POOL/PACT expressly acknowledges that the site may contain content provided by other POOL/PACT members and/or other organizations and individuals and assumes no responsibility for the accuracy of or liability for such content.
The content on the POOL/PACT website is protected by various forms of proprietary rights. All content on the site is owned by POOL/PACT other parties, who are identified as owners, when appropriate, and have granted POOL/PACT the use of their content. Content published on this website (digital downloads, images, texts, graphics, logos) is the property of POOL/PACT and related entities, and/or its content creators and protected by international copyright laws. You may not use this website for any illegal or unauthorized purpose. You agree to comply with all laws, rules and regulations (federal, state, and local) applicable, including but not limited to, copyright laws.
The entire communication with us is electronic. Every time you send us an email or visit our website, you are going to be communicating with us. You hereby consent to receive communications from us. We will continue to communicate with you by posting news and notices on our website and by sending you emails. You also agree that all notices, disclosures, agreements and other communications we provide to you electronically meet the legal requirements that such communications be in writing. You must not interfere or disrupt the Service or servers or networks connected to the website, including by transmitting any worms, viruses, spyware, malware or any other code of a destructive or disruptive nature. Disputes and Applicable Law
All disputes shall be governed by Nevada law, without regard to conflicts of law principles. The parties agree that jurisdiction and venue for any dispute arising out of or relating to the Agreement shall be exclusively within the state courts or other tribunals located in Carson City, Nevada and the parties hereby waive any objection to such jurisdiction and venue. Violation of these Terms of Service may, in POOL/PACT’s sole discretion, result in termination of your access and account. You understand and agree that POOL/PACT cannot and will not be responsible for the content posted on the website and you use the website at your own risk. If you violate the letter or spirit of these Terms of Service, or otherwise create risk or possible legal exposure for POOL/PACT, we can stop providing all or part of access to you.
Comments, Reviews, and Emails
Visitors may post content as long as it is not obscene, illegal, defamatory, threatening, infringing of intellectual property rights, invasive of privacy or injurious in any other way to third parties. Content has to be free of software viruses, political campaign, and commercial solicitation.
We reserve all rights (but not the obligation) to remove and/or edit such content. When you post your content, you grant POOL/PACT non-exclusive, royalty-free and irrevocable right to use, reproduce, publish, modify such content throughout the world in any media.
License and Site Access
We grant you a limited license to access and make use of this website for the exclusive benefit of the public.
If you are an owner of an account on this website, you are solely responsible for maintaining the confidentiality of your private user details (username and password). You are responsible for all activities that occur under your account or password. We reserve all rights to terminate accounts, edit or remove content and cancel orders in their sole discretion.
